The Truth About Case Numbers and Legal Fictions

By: Joel Stephen Mattson

What if I told you the moment a case number is assigned to you, the government is no longer dealing with you, but a legal fiction? That you’re not the “person” listed on that docket—but rather, they’re prosecuting a paper entity created in your name to bypass the Constitution? In this article, we’ll uncover the hidden trap behind case numbers, the use of legal fictions, and how these deceptive tricks form the very foundation of most court proceedings—especially those happening in Article I administrative courts.

This is the fraud no one tells you about—because if they did, the entire system would unravel.

What Is a Legal Fiction and Why Does It Matter?
A legal fiction is a false assumption accepted by a court for the sake of procedure. The most dangerous of these is the all-caps version of your name—JOHN DOE vs. John Doe. This is no accident. The all-caps entity represents a corporate fiction, created by the government and tied to your birth certificate. It’s not you, but a trust, corporation, or vessel that they use to extract jurisdiction.

The U.S. Supreme Court in Penhallow v. Doane’s Administrators, 3 U.S. 54 (1795), stated that governments are artificial entities and can only interact with other artificial persons. That means they cannot lawfully govern or interact with a living man or woman—unless you consent to be treated as a corporate fiction.

If you’ve read the article titled The Fraud of Article I Courts: Why Most Judges Aren’t Real Judges, you already know most courts today aren’t even real constitutional courts. When a case is filed using all caps, with a docket number, and served through commercial paper—what they’re actually doing is trying to bind the living man or woman into a contractual commercial action without your knowledge.

Where Do Case Numbers Come From?
Case numbers are tracking numbers—not for justice, but for commerce. The court system is tied directly to corporate and banking systems. Every case generates a bond, and that bond is traded—just like your birth certificate bond. The moment a case is opened, your legal fiction becomes the defendant, and unless you rebut the presumption, the court proceeds as if you are the corporate entity.

They’ll never come out and say this. But the evidence is everywhere:

  • You’re not listed in lowercase (as is proper under grammar rules).
  • The court never refers to you as “the man” or “the woman.”
  • All correspondence is addressed to the all-caps NAME.
  • Your social security number, birth certificate, and address are all used to link you to the corporate fiction.

Constitutional Authority vs. Administrative Procedure
Article III, Section 2, Clause 1 of the U.S. Constitution limits federal judicial power to real cases and controversies involving real people and real harm. That means unless there is a clear injury, a party with standing, and a constitutional authority to act—there is no case.

But when a case number is generated based on commercial code, not constitutional authority, everything changes. You’re no longer in a court of law—you’re in a court of contract. And unless you object, rebut the presumption, and assert your status as a living man, they will proceed against the legal fiction while pretending it’s you.

If you haven’t yet read The Courtroom Consent Game: How Silence Becomes Your Enemy, go back and do so. That article lays the foundation for understanding how courts move forward based on what you don’t say—and how that silence is used to falsely equate you with the legal fiction.

Supreme Court Cases That Expose the Fiction

  • Hale v. Henkel, 201 U.S. 43 (1906): “There is a clear distinction in this particular case between an individual and a corporation…”
  • United States v. Minker, 350 U.S. 179 (1956): “We must consider the constitutional limitations on such procedures.”
  • Crain v. Commissioner, 737 F.2d 1417 (5th Cir. 1984): The burden to prove jurisdiction lies on the government.
  • Thompson v. Smith, 154 S.E. 579 (1930): “The right of a citizen to travel… is a common right.”

Real-World Example: Joel’s Property Tax Lawsuit
When Callahan County, Texas tried to sue me over property taxes, they didn’t name me—they named the corporate fiction. My response was clear, lawful, and constitutional: I am not the corporate entity. I do not consent. I rebut all presumptions. I invoked Article III, Section 2, Clause 1 of the Constitution and denied all jurisdiction.

What happened next? Nothing. They never replied. The case went dead. Why? Because when you destroy the presumption of jurisdiction, the court loses the ability to proceed.

What Others Have Done to Win Their Case
Many others have won by filing affidavits denying joinder to the NAME, asserting their status as a living man or woman, and challenging jurisdiction at the first moment. These methods have caused prosecutors to drop charges, judges to recuse themselves, and entire proceedings to collapse.

How to Fight Back Against the Legal Fiction

  1. Never answer to the NAME without status clarification.
  2. File an affidavit of status.
  3. Object early—verbally and in writing.
  4. Refuse all adhesion contracts.
  5. Demand constitutional jurisdiction.
  6. Reject all presumed joinder.

Final Thoughts
The court isn’t operating on facts—it’s operating on presumptions. And the biggest one is that you are the NAME on that docket. You’re not. You’re a living man. And unless you object, they’ll keep operating under that presumption and pretending it’s law.

Because the truth is: they’re only winning because you don’t fight back on paper.

Make the record yours.

And let their own filings take them down.
